The docket
The first AI copyright jury trial has no trial date, and the docket says so
Andersen v. Stability AI, the artists’ case against Stability, Midjourney, DeviantArt and Runway in the Northern District of California, is still in fact discovery, and what is being fought over is evidence. The docket’s last fortnight holds a letter on Stability’s failure to preserve evidence, one on Runway’s discovery violations, a 3 September dispute over Midjourney clawing back a document at the deposition of its founder David Holz, and a plaintiffs’ motion for sanctions against DeviantArt set for hearing before Judge William Orrick on 7 October. No entry sets a trial, and the paper’s reading is that the case’s news is now what the defendants kept, not what the model copied.
What it changes No jury guidance on whether a model is an infringing copy is coming this month; plan against the sanctions hearing on 7 October, not a verdict.
